Were you the driver at the time?

What does this mean?

Were you the driver?

If you were the driver, please complete Part1 of the Section 172 form you should have been sent. If you were not the driver, you will need to prove this by providing more information about either who the driver was at the time of the offence, details about any hire or lease agreement if the car is currently under lease, or if you were not the owner/keeper.

What was the offence?

If somebody else was driving then you must provide the drivers details using the S172 form. This comes with the Notice of Intended Prosecution.

If you have already ready returned you S172, don’t worry, that’s all we need for now. Kent Police will be in touch if there is anything else you can help with.

If you need a new S172 form please contact the Kent Police Driver Diversion Team.

The types of letters you could receive.

Firstly you'll receive a Notice of Intended Prosecution from Kent Police. This will be sent to the registered keeper of the vehicle. They must respond to confirm they were the driver, or to confirm who was driving, with the drivers details.

After the correct driver is identified, they will receive a Conditional Offer letter from Kent Police to say what options they have, which depends on the seriousness of the offence.
